Divorce Law fundamentally changed from 6 April 2022.  Resolution (of which our lawyers are members) have campaigned for this change for a long time, and it is widely supported within the profession.

To obtain a divorce you need to show that you have been married for more than a year and that the marriage has broken down irretrievably.
 
The application can be made by one Party, or by both spouses jointly.  We can guide you through the best option for your individual circumstances.  Following the application, the Respondent will then receive a Notice of Proceedings and will be advised by communication from the Court how to deal with the divorce application.  

There is a compulsory waiting period of 20 weeks from the application until the Conditional Order can be made by the Court (the interim divorce Order).  This is to provide spouses with a period of reflection before the divorce is progressed.  After the Conditional Order has been made, the applicant (or joint applicants) can apply for the Final Order when a further cooling off period of 6 weeks and 1 day from the Conditional Order has expired.
 
The divorce process can take as little as 7 - 9 months from start to finish if the divorce is relatively straightforward.  If financial matters are in prolonged dispute the process can take somewhat longer.  Our strong recommendation is that clients take advice at the earliest possible stage in order that they are fully aware as to their options and potentially to gain a tactical advantage in the negotiation of their respective positions.
